The National Emissions Standards for Hazardous Air Pollutants (NESHAP) ‘notifications’ are required for all demolitions (excluding single family homes, or multi-family homes with 3 units or less) and are also required for many renovations. These are EPA regulations enforced by the California Air Resources Board. Most contractors/building owners become aware they need a NESHAP permit when they submit plans for a demolition or renovation to their local building department. In order to comply with the notification requirements to NESHAP, you need to have certified individuals perform an asbestos survey to determine if you have an asbestos-containing materials that will be impacted by your project. All work needs to be completed and a notification with all required information, including the asbestos survey or results thereof, must be submitted a minimum of 10 working days prior to disturbance of any asbestos-containing materials and/or before demolition/renovation work begins (regardless of the presence or absence of asbestos).
What constitutes a demolition? NESHAP regulations have a specific definition for what constitutes as a demolition = removal of a “load-bearing structural member” is considered a demolition.
